Terms of Service
Straightforward and fair. We've kept the legalese to a minimum so you can actually understand what you're agreeing to.
These Terms of Service ("Terms") govern your use of the NOTaRentalQR website and service ("Service") operated by FGX (Pty) Ltd, South Africa ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.
1. The No-Rental Promise
Your codes are yours — forever.
Static QR codes encode data directly and never touch our servers after generation. They work forever with no account required.
Dynamic QR codes are managed through your account. If you cancel a paid plan, your dynamic codes do not break and do not show a paywall. They fall back to the last destination you saved. We will not hold your codes hostage to force a renewal.
2. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your password and for all activity under your account. Notify us immediately at hello@notarentalqr.com if you suspect unauthorised access.
You must be at least 13 years old to use the Service. By registering you confirm you meet this requirement.
3. Acceptable Use
You may use the Service for any lawful purpose. You may not use it to:
- Distribute malware, phishing pages, or other malicious content
- Violate any applicable law or regulation
- Infringe the intellectual property rights of others
- Spam, harass, or deceive other people
- Attempt to gain unauthorised access to our systems
- Resell or sublicence access to the Service without our written consent
We reserve the right to suspend or terminate accounts that violate these rules without notice.
4. Plans and Billing
Free plan
The Free plan is provided at no charge and includes a limited number of static QR codes. No payment information is required.
Paid plans
Paid plans (Starter, Growth, Pro, Scale) are billed monthly or annually as selected at checkout. Prices are shown in US dollars on the pricing page. Payment is processed by PayPal.
Annual billing
Annual plans are charged as a single upfront payment covering 12 months of access. Your access period is set accordingly.
No automatic renewals
We do not auto-charge you. When your paid period expires, your account returns to the Free plan. Your codes are not deleted — see Section 1 (The No-Rental Promise). To continue paid access, purchase a new plan from your dashboard.
5. Refund Policy
If you are not satisfied with a purchase, contact us at hello@notarentalqr.com within 48 hours of payment and we will issue a full refund, no questions asked. After 48 hours, refunds are assessed on a case-by-case basis at our discretion.
6. Intellectual Property
Your content is yours. You retain all rights to the content you encode in QR codes (URLs, contact data, text, etc.).
The NOTaRentalQR brand, software, design, and documentation are owned by FGX (Pty) Ltd. You may not copy, modify, or distribute them without permission.
7. Service Availability
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, apply updates, or experience outages. Static QR codes are unaffected by service interruptions — they encode data directly and require no server. Dynamic code redirects may be temporarily unavailable during outages.
8. Limitation of Liability
To the fullest extent permitted by law, NOTaRentalQR and FGX (Pty) Ltd are not liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost profits, lost data, or business interruption.
Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.
9. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
10. Account Termination
You may delete your account at any time from Settings. We may terminate or suspend your account for violations of these Terms. Upon termination your personal data will be deleted in accordance with our Privacy Policy.
11. Changes to These Terms
We may update these Terms. Material changes will be communicated by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
